Terms of Use, Privacy, and GDPR (Important)
This document explains the terms that apply when you use PathlyAI (the mobile app and related websites), and provides a high-level overview of privacy, data processing, and user rights under the GDPR. If you do not agree with these terms, do not use PathlyAI. By using the app, you confirm that you have read, understood, and accepted these terms. Last updated: 2026-01-26
1. Who we are and what PathlyAI is
PathlyAI is a wellbeing tool designed to support calmer decision-making and mental clarity. It helps you recognize how you feel in a given situation and guides you toward a practical next step through short exercises for calm, focus, and habit change, across topics such as worry, thoughts, stress, relationships, and sleep. 2. Critical notice: Not a medical app, not emergency support
PathlyAI is not a medical application. It does not provide diagnoses and does not replace professional help (such as a physician, psychiatrist, psychologist, psychotherapist, or other qualified professional). PathlyAI is not intended for emergencies or crisis situations. If you believe you are in immediate danger, are considering self-harm, or there is a risk to you or others: - call your local emergency number immediately (in many EU countries this is 112), - contact local crisis services, and/or - go to the nearest emergency medical facility. If you are already receiving professional care, PathlyAI may be used as a self-support tool between appointments, but it is not a substitute for therapy or medical treatment.
3. AI, limitations, and your responsibility when using the app
Parts of PathlyAI may use automated systems that generate text-based guidance based on your inputs. Such outputs may be inaccurate, incomplete, not suited to your context, or misunderstood. You remain in control: - you decide what is helpful for you, - you decide whether to act on any suggestion, - if something feels wrong or distressing, stop the session and seek support in the real world. PathlyAI does not provide legal, medical, psychiatric, or other professional advice.
4. Eligibility (age and suitability)
The service is intended for adults (18+), unless local laws allow otherwise and any required parental/guardian consent is obtained. We may restrict or refuse access in jurisdictions where use would violate applicable law or platform rules (Apple/Google).
5. Accounts, security, and access responsibility
To use PathlyAI, you may need to create an account. You are responsible for: - providing accurate registration information, - keeping your login credentials secure, and - all activity that occurs under your account. If you suspect unauthorized access, contact us as soon as possible at [email protected].
6. Acceptable use and conduct rules
PathlyAI is provided for personal, non-commercial use. You must not: - use the app for unlawful purposes, - harass, abuse, threaten, or discriminate against others, - attempt to obtain identities, private information, or access to other users' accounts, - submit content containing malware, viruses, or code that compromises security, - attempt to reverse engineer, decompile, or bypass protections, - scrape the service or automate extraction at scale, - overload our infrastructure or interfere with service operation. We may suspend or terminate accounts that violate these rules to protect users, security, and service integrity.
7. Your content, confidentiality of inputs, and processing permission
You retain ownership of the content you enter (such as text responses and notes). However, to provide the service, you grant us a limited permission to process that content: - to store and display it to you within the app, - to use it to generate responses and guide sessions, - to perform basic analytics for reliability, security, abuse prevention, and quality improvement. We do not use your personal session content for public publication. If we ever introduce an option to use your data for model training or other purposes that are not necessary to provide the service, we will explain it clearly and, where required, request additional consent.
8. Subscriptions, purchases, and refunds (Apple App Store and Google Play)
PathlyAI may offer subscriptions or in-app purchases. If you purchase through Apple App Store or Google Play: - billing, cancellation, and refunds are governed by Apple or Google policies, - we cannot guarantee refunds beyond the relevant platform rules, - you typically manage subscriptions in your Apple/Google account settings. If you purchase directly via our website (if available): - the terms shown at the time of purchase apply, - where applicable, we will honor statutory consumer rights (such as withdrawal rights), except where the law provides an exception for digital content once performance has begun. 9. Availability, service changes, and technical interruptions
We aim to keep PathlyAI stable, but we do not guarantee uninterrupted availability. We may: - modify features, - add or remove parts of the service, or - temporarily suspend access for maintenance, security, or improvements. We do this to improve quality and protect users and the service.
10. Intellectual property
All software, design, visual identity, text, interface elements, logos, and other materials within PathlyAI (excluding content you provide) are owned by PathlyAI, d. o. o. or its licensors and are protected by intellectual property laws. You must not: - copy, distribute, sell, or commercially exploit any part of the app, - create derivative works, or - use our trademarks or branding without written permission.
11. Third-party services and links
PathlyAI may include links to, or integrations with, third-party services (for example Apple, Google, payment processors, analytics, or hosting providers). Third parties have their own terms and privacy policies. We do not control their practices and are not responsible for their actions. We recommend reviewing their policies before using their services.
12. Account and data deletion
You can request account deletion within the app: Profile -> Settings -> Delete Account (or an equivalent path in the final UI). Alternatively, you may email a deletion request: - subject: "Account Deletion Request" - send to: [email protected] - include: your account email and, if available, your user ID. To protect privacy, we may request additional verification before deletion. What deletion means: - your account is deactivated, - personal data and content are removed or anonymized within a reasonable period, unless we must retain certain data for legal obligations (for example billing/accounting records) or to prevent abuse. Backups: - due to technical constraints, data may persist in encrypted backups for a limited period, is not actively accessible through the app, and is removed through normal backup rotation to the extent feasible.
13. Privacy: a short overview (see our full Privacy Policy for details)
Privacy matters to PathlyAI. This section is a high-level overview. Full details should be provided in the dedicated Privacy Policy available within the app and on our website. We may process: - account data (for example email), - technical data (for example device type, app version, crash/error logs), - content you provide in sessions (for example text responses), to the extent necessary to provide the service. Purposes of processing: - providing and maintaining the service, - security and abuse prevention, - customer support, - improving functionality and quality. Sharing: - we may share data with trusted processors (hosting, analytics, support, billing) only as necessary to deliver services on our behalf, under confidentiality and security obligations, - we may disclose data if required by law or a competent authority. 14. GDPR: user rights and legal bases
If the GDPR applies to you (for example if you are in the EU/EEA), you have rights including: - the right to access, - the right to rectification, - the right to erasure (where applicable), - the right to restriction of processing, - the right to object, - the right to data portability (where applicable), - the right to withdraw consent where processing is based on consent. Legal bases for processing may include: - contract performance (to provide the service), - legitimate interests (for example security, abuse prevention, reliability), - consent where required (for example optional processing that is not necessary for core service delivery). 15. Disclaimer of warranties
PathlyAI is provided "as is" and "as available" to the extent permitted by applicable law. We do not warrant that the service will always be: - uninterrupted, - error-free, - fully accurate, or - suitable for every individual situation. This does not affect mandatory consumer rights that cannot be excluded.
16. Limitation of liability
To the extent permitted by applicable law, PathlyAI, d. o. o. is not liable for indirect, special, or consequential damages arising from your use of, or inability to use, PathlyAI. Nothing in these terms excludes or limits liability that cannot be excluded by law (for example liability for intentional misconduct or gross negligence, or for death/personal injury where such limitation is prohibited).
17. Indemnity (reasonable scope)
If you breach these terms and this causes loss or a third-party claim against us, you agree to compensate us for reasonable losses and costs resulting from that breach, to the extent permitted by applicable law and subject to applicable consumer protections.
18. Governing law and jurisdiction
These terms are governed by the laws of Slovenia, unless mandatory consumer protection laws in your country require otherwise. Courts in Ljubljana have jurisdiction over disputes, unless consumer protection rules require a different forum.
19. Changes to these terms
We may update these terms from time to time to reflect legal requirements, security needs, or service development. If we make material changes, we will post the updated version in the app and/or on our website and, where appropriate, notify you. Continued use after the effective date of changes constitutes acceptance of the updated terms.
